Terms of Service

01Introduction

These Terms of Service ("Terms") govern your use of RevenueOS, including the RevenueOS web app, the RevenueOS mobile app and this website (together, the "Service"). The Service is provided by El Vivid Ltd ("Vivid", "we", "us"), a company registered in Ghana.

By creating an account, connecting an account, or using the Service, you agree to these Terms. If you use the Service for a business, you confirm that you have authority to accept these Terms for that business, and "you" means that business.

If you have a signed agreement or order with us for RevenueOS, and it conflicts with these Terms, the signed agreement takes priority.

02The Service

RevenueOS helps businesses turn interest from social media into paying customers. It lets you:

• connect your Facebook Page, Instagram business account and WhatsApp Business number;
• receive messages and Meta ad lead-form leads in one place, and reply to them;
• see which ad or campaign each lead came from, where that information is available;
• move leads through a sales pipeline, and assign follow-up tasks to your team.

The RevenueOS mobile app is in early access. It may have fewer features than the web app, and it may change as we develop it.

03Your account

• The Service is for businesses. You must be at least 18 to use it.
• Give us accurate information, and keep it up to date.
• Keep your login details safe. You are responsible for what happens under your account, including what your team members do.
• Tell us straight away at customercare@vividconcepts.site if you think someone has used your account without permission.

04Connecting Meta accounts

RevenueOS works by connecting to Facebook, Instagram and WhatsApp through Meta's official tools. When you connect an account:

• you confirm that you own or are authorised to manage that Page, account, phone number or ad account;
• you allow us to access it with the permissions you grant, as described in our Privacy Policy;
• you agree to follow Meta's terms and policies that apply to you, including the Meta Business Tools Terms, WhatsApp Business policies and Meta's advertising policies.

You can remove RevenueOS's access to an account at any time in your Facebook settings, or ask us to disconnect it. See our data deletion page for how.

05Messaging your customers

You are responsible for the messages your team sends through RevenueOS. You agree to:

• only message people who have contacted you or agreed to hear from you, as Meta's rules and the law require;
• respect Meta's messaging windows and template rules, and stop messaging anyone who asks you to;
• not send spam, misleading claims, or anything unlawful, abusive or harmful.

If Meta limits or blocks your account because of how it was used, we are not responsible for that.

06Your data and your customers' data

You own the data you and your customers put into RevenueOS ("Your Data"). You give us permission to store and process Your Data only to provide, secure and support the Service for you.

For personal data about your customers, you are the data controller and we are your data processor, as explained in our Privacy Policy. This means:

• we process it only on your instructions, and only to provide the Service;
• you are responsible for having a lawful basis to collect and use it, and for telling your customers how you use their data;
• we will help you respond to requests from your customers to see, correct or delete their data;
• if one of your customers asks us directly to delete their data, you allow us to delete it from RevenueOS, and we will tell you when we do;
• we will not sell it, or use it for advertising.

You can ask us for a copy of Your Data, or ask us to delete it, at any time. Deletion is handled by our team on request, as described on our data deletion page.

07Acceptable use

You must not:

• use the Service to break the law, or Meta's terms and policies;
• try to access accounts, data or systems you are not authorised to use;
• disrupt, overload, copy, reverse engineer or resell the Service;
• upload viruses or harmful code;
• use the Service to harass anyone, or to collect data about people in ways they would not expect.

08Fees and payment

The fees for RevenueOS are agreed with you in writing before you start, in a quote, order or agreement. Unless that document says otherwise:

• you will pay invoices by the due date shown on them;
• fees do not include taxes, which are added where the law requires;
• if a payment is late, we may pause your access after giving you notice, until it is paid.

09Meta and other third-party services

The Service depends on Facebook, Instagram, WhatsApp and other services we don't control. Meta may change, limit or stop its tools at any time, and that may affect what RevenueOS can do. We will do our best to keep the Service working when that happens, but we are not responsible for third-party services, and their own terms apply to your use of them.

10Availability and changes

We work to keep RevenueOS running smoothly, but we don't promise that it will always be available, uninterrupted or free of errors. We may need to pause it for maintenance or updates. We may improve, change or remove features over time. If we make a change that significantly reduces what you've paid for, we will tell you in advance.

11Intellectual property

RevenueOS, including its software, design, text and logos, belongs to El Vivid Ltd or its licensors. These Terms give you the right to use the Service while your account is active. They don't give you ownership of it. If you share feedback or ideas, we may use them to improve the Service without owing you anything.

12Confidentiality

We treat Your Data and any non-public information about your business as confidential. We only share it as our Privacy Policy describes, or with your permission.

13Suspension and termination

• You can stop using RevenueOS at any time. Let us know, and we will close your account. Any fees already due remain payable.
• We may suspend or close your account if you seriously or repeatedly break these Terms, if you don't pay, or if we must do so to comply with the law or Meta's requirements. Where we can, we will warn you first.
• When your account closes, your access ends. You can ask for a copy of Your Data before it closes. We then delete Your Data as described in our Privacy Policy.

14Disclaimer

The Service is provided "as is" and "as available". To the fullest extent the law allows, we make no promises about it beyond those in these Terms. We don't guarantee any particular number of leads, sales or results.

15Limitation of liability

To the fullest extent the law allows:

• El Vivid Ltd and its directors, employees, partners and suppliers are not liable for any indirect, incidental or consequential losses, including lost profits, revenue, data or goodwill, arising from the Service;
• our total liability to you for any claim about the Service is limited to the fees you paid us for RevenueOS in the 12 months before the claim arose.

Nothing in these Terms limits any liability that cannot be limited under Ghanaian law.

16Your responsibility for claims

If someone makes a claim against us because of the messages you sent, the data you collected, or your breach of these Terms or of Meta's policies, you agree to cover our reasonable costs and losses from that claim.

17Changes to these Terms

We may update these Terms from time to time. When we do, we'll post the new version on this page and change the "last updated" date. If a change is significant, we'll tell you before it takes effect. If you keep using the Service after that, you accept the updated Terms.

18Governing law

These Terms are governed by the laws of the Republic of Ghana, and any disputes will be handled by the courts of Ghana.
